Clauses

The service and your account

Aqarly is a cloud-based property and rental management service accessed through a web browser. The service is used through a personal account linked to your organization's account, and your subscription includes the number of users specified in your plan. Each user must have their own account, and sign-in credentials may not be shared. Aqarly permits one active session per account; signing in from another device automatically ends the previous session. All intellectual-property rights relating to the service remain owned by their respective owners in accordance with applicable laws and agreements.

Fees and no refunds

Subscription fees are payable in advance for the full subscription term. Except where required by applicable law, all amounts paid are non-refundable, in whole or in part, including if you cancel before the end of the subscription term or stop using the service. A free trial is available before a paid subscription so that you can assess whether the service meets your needs.

Availability and connectivity

The service operates over the internet and requires an internet connection. We work to maintain a high level of availability, but we do not guarantee uninterrupted operation or that the service will be free from maintenance periods, faults, or circumstances outside our control.

Subscription expiry and access to your data

If your subscription expires or is suspended, your organization's account may switch to view-only mode. You may continue to access, print, and export your data using the features available in the service. Your data is not deleted solely because your subscription expires, and editing access may resume when the subscription is renewed, subject to the status of the account.

Acceptable use

You agree to use the service only for lawful purposes and in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia. You must not attempt to breach, disrupt, misuse, gain unauthorized access to, resell, or otherwise make the service available to others in violation of these terms.

Your responsibility for outputs

Aqarly is an assistive business-management tool and is not a substitute for legal, accounting, tax, or other professional advice. You are responsible for verifying the accuracy and legality of all data, documents, calculations, and other outputs you create or rely on through the service, including contracts, receipts, reports, calculations, and data imported from Ejar or any other source. You are also responsible for your own business decisions and regulatory and tax obligations.

Disclaimer of warranties

The service is provided "as is" and "as available", without warranties of any kind, express or implied, to the extent permitted by applicable law, including warranties of fitness for a particular purpose, error-free operation, or uninterrupted availability.

Limitation of liability

To the extent permitted by applicable law, Aqarly is not liable for indirect, consequential, or special damages, or for loss of profits, revenue, or data arising from the use of, or inability to use, the service. To the extent permitted by applicable law, Aqarly's total aggregate liability relating to the service will not exceed the subscription fees you paid during the twelve months preceding the event giving rise to the claim.

Your data and export

Your organization's data is stored within the service so that you can use and access it, and operational backups are maintained as part of operating the service. You may export your data from within the service using the export options made available to you. If your account is permanently closed, your data will be handled and deleted in accordance with the applicable data-retention policy, after a reasonable period for export where applicable. You authorise Aqarly to use your organization's contract data to compute aggregated, anonymous market indicators and show them to users of the service, as described in the Privacy Policy, unless the organization's owner or an administrator turns this off in Settings.

Termination and governing law

The subscription may be suspended or terminated if these terms are breached, to the extent permitted by applicable law. Termination for breach does not entitle you to a refund, except where required by applicable law. These terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.
